Terms of use

1. Scope

1.1 The following General Terms and Conditions (GTC) apply to all contracts between Restaurant Feinberg's (hereinafter referred to as "Restaurant") and its guests (hereinafter referred to as "Customer") for the provision of gastronomic services.

1.2 Deviating, conflicting or supplementary conditions of the customer, even if they are known, do not become part of the contract unless their validity is expressly agreed to in writing.

 

2. Reservations & Cancellation

2.1 Reservations can be made by telephone, email or via the online booking tool.

 

2.1.1 A binding Ticketing between the restaurant and the customer comes about through the reservation confirmation of the restaurant.

2.1.2 The restaurant reserves the right to refuse or cancel reservations, in particular in the event of force majeure, unavailability of services or reasonable doubts about the customer's ability or willingness to pay.

2.2 For group reservations of 10 or more people, a deposit of €15.00 per person is required.

Alternatively, the customer can use a cost assumption created by the provider. A deposit is then not required.

2.3 Group reservations can be canceled free of charge up to 96 hours before the date of publication. For cancellations within 96 hours before the agreed publication date, the following cancellation fees are due:

2.3.1 Groups up to 15 people:

  • Cancellation less than 24 hours before the date of publication (including individuals): 100% of the total amount.

  • Cancellation 24 to 48 hours before the date of publication (including individuals): 50% of the total amount.

  • Cancellation 48 to 72 hours before the publication date: You cancel free of charge.

2.3.2 Groups of 16 or more people:

  • Cancellation less than 24 hours before the date of publication (including individuals): 100% of the total amount.

  • Cancellation 24 to 48 hours before the date of publication (including individuals): 50% of the total amount.

  • Cancellation 48 to 72 hours before the publication date (including individuals): 25% of the total amount.

  • Cancellation 96 hours before the publication date: You cancel free of charge.

2.4 If no deposit has been agreed, the fee refers to the total deposit amount that has normally to be paid, which consists of the number of people x 15.00 € (der regular deposit fee) results.

In the case of a binding booking of meals and extras, the fee results from the number of people x the agreed menu price + extras.

2.5 A cancellation must be made in writing (by email or letter) and confirmed by Restaurant Feinberg's.

3. Payment

3.1 The agreed remuneration is paid in cash or by bank transfer. 

3.2 Invoices are payable within 7 days of receipt without deduction.

3.3 The restaurant reserves the right to charge default interest of 5 percentage points above the respective base rate in the event of late payment.

4.Return of food and wine

4.1 If the customer is dissatisfied with the quality or taste of the food or wine ordered,

this must be reported to the staff immediately.

4.2 Returns of food and wine can only take place due to objective defects such as: burnt, undercooked, spoiled, corked, sour (for wine), etc. . A return due to personal taste (subjective defect) is excluded.

4.3 In the event of an objective notice of defects, the restaurant is entitled to offer the customer an appropriate replacement service or to refund the purchase price.

5. Liability

5.1 The restaurant is only liable for damage caused by intent or gross negligence.

5.2 The restaurant is not liable for the wardrobe, things and valuables of the guests.

6. Severability

Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The statutory regulations shall take the place of the ineffective provisions.
